City of Fargo withdraws annexation of Harwood ETJ land, sends other annexation for mediation

FARGO, N.D. – The Fargo City Commission has withdrawn their annexation of land that is under the extraterritorial territory of the City of Harwood.

The land in the annexation is land that is owned by Applied Digital. It’s building an artificial intelligence data center on the land. Both Applied Digital and the City of Harwood have been against the annexation process that the City of Fargo has undertaken.

“We looked at a variety of solutions to this problem, but it was  (city attorney) Ian (McLean)’s recommendation that, if you withdraw your annexation movement, then basically Harwood would proceed with annexing this area,” Fargo Mayor Dr. Tim Mahoney said.

Commissioner Dave Piepkorn said that while he votes for the withdrawal, he asked that City Attorney Ian McLean make a stipulation that the City of Fargo’s Fire Department will not respond to calls for its hazardous materials team to respond to a call at the data center.

The Commission voted 5-0 to withdraw the annexation of land owned by Applied Digital.

East half annexation

The Commission voted to submit the Fercho land annexation issue to mediation, which is in the Fargo extraterritorial jurisdiction.

Commissioner Denise Kolpack made the motion, which was seconded by Piepkorn.

The Commission voted 4-1 to send the issue to mediation.
