Majority of Businesses Pass Recent Tobacco Compliance Checks

(Fargo, ND) – Tobacco compliance checks were recently performed in Fargo on September 22 and West Fargo on September 28. In Fargo, thirty-three businesses were checked and twenty-six passed, resulting in a 79% success rate.  In West Fargo, thirteen businesses were checked and twelve passed, resulting in a 92% success rate.

Fargo Cass Public Health appreciates the cooperation of local tobacco retailers in ensuring tobacco products, including e-cigarettes, are not being sold to minors. Licensed tobacco retailers are encouraged to regularly review city ordinances and state laws related to sale of tobacco products and to include this important information in training for new employees.

           

Fargo businesses that failed:

 

· Bjornson Oil, 734 North University Drive – first fail in one year

· Casey’s General Store, 4301 13th Avenue South ­– first fail in one year

· Family Fare, 724 North University Drive –  first fail in one year

· Holiday Station Store, 101 North University Drive – first fail in one year

· Hornbacher’s, 1433 South University Drive – first fail in one year

· Love’s Travel Stop, 3220 39th Street South – first fail in one year

· Casey’s General Store, 1401 South University Drive – second fail in one year

 

West Fargo businesses that failed:

 

· Holiday Station Store, 2020 Sheyenne Street – first fail in one year

 

Penalties in Fargo:

 

· The first failure in a one-year time period – one-year probation and a $500 administrative fee

· The second failure in a one-year time period – three-day suspension of the tobacco license and a $500 administrative fee

· The third failure in a one-year time period – ten-day suspension of the tobacco license and a $500 administrative fee

 

Penalties in West Fargo:

 

· The first violation – written warning including one-year probation

· The second failure during probationary period – three-day suspension of the tobacco license

· The third failure during probationary period – ten-day suspension of the tobacco license

· Subsequent violations during probationary period – 30-day suspension of the tobacco license
