(Jamestown, ND) -- An appeal is being denied for a Jamestown man convicted of attempted murder.

North Dakota Supreme Court Justices upheld Cory Almklov's conviction, which included other charges such as providing false information to law enforcement. Almklov was tried in March 2021 after prosecutors say he hit a man in the head with a brick and called 911 to report the victim had slipped and fallen.

Almklov argued on appeal that the district court didn't properly instruct the jury.
