(Fargo, ND) -- UPDATE: A representative for Fargo Public Schools has provided this clarification to WDAY News First to the initial version of this story posted below.
CLARIFICATION FROM FPS: "FPS will petition the Office of Administrative Hearings to appoint an administrative law judge to a discharge for cause hearing for Mr. Kennedy. The ALJ will preside over the hearing. They will not review the case, but simply preside over the proceedings."
An English teacher at Fargo South has been suspended without pay for alleged inappropriate behavior toward students.
The school board took the action against Kevin Kennedy Tuesday. He is accused of making unwanted physical contact with students and making inappropriate comments. The superintendent is recommending Kennedy be fired.
Kennedy's case will next be reviewed by a state administrative law judge.
