(Fargo, ND) -- The Fargo City Commission is holding an executive session in their chambers at City Hall Wednesday at noon.

The move is to consult city attorneys regarding a pending lawsuit involving SouthTown Pourhouse. This stemming from what the city calls a failure to meet the 50/50 food and liquor distribution requirements to operate with a liquor license.

The issues have stemmed from 'infractions' dating back to 2019 involving the business and Duane's Pizza, which is located in the same building but not an official food partner of SouthTown.

The city says to discuss the litigation in an open meeting would 'have a negative fiscal effect' on the bargaining and/or position of the city.
