(Bismarck, ND) -- The North Dakota Supreme Court is set to hear a case determining who has the mineral rights to porous spaces within rocks.
A group of landowners has sued, claiming a specific law has deprived them of their right to compensation for use of those cavities. Senate Bill 2344 passed in 2019 with the support of the state's oil and gas industry, which provides companies with more control over energy storage spaces.
The spaces can also be used to store carbon dioxide, which helps boost oil production in old oil fields.
