Walsh County reckless endangerment case dismissed

(Grafton, ND) – A case against a Walsh County man accused of three counts of reckless endangerment has been dismissed.

George Tibert was charged in late October, and has been held in jail without bond since a bond hearing on October 23.

In a ruling released Tuesday morning by Judge Donovan Foughty in Northeast Judicial Court, “the Court cannot conclude there is clear and convincing evidence the State is acting in bad faith or contrary to public interest, or intentionally harassing the defendant. This determination should be made by clear and convincing evidence.”

The ruling goes on to say the “victims have the right to be heard.”

The case is dismissed without prejudice, Foughty’s ruling said.
