(Fargo, ND) -- Clay County Sheriff Mark Empting says 20 percent of the inmates in the county jail have mental health issues and that some of them should not be jailed.

"Essentially what we are doing here is when we keep these people in our facilities for that long, all we are doing is criminalizing mental health and we just have to as a state, they have to figure something out here. They've got to get more beds for these folks so we can get them out of our facilities and get them the help that they need," said Empting.

Empting said some of the inmates "need mental health care and not correctional care".

The sheriff made the comments while appearing on The Flag's "What's on Your Mind".
