N.D. Legislative Assembly asks Supreme Court to allow vote on amending term limits in Constitution

BISMARCK, N.D. – A brief filed with the North Dakota Supreme Court asks the court to allow North Dakota residents to vote on whether or not they support Senate Concurrent Resolution 4008.

Two former legislators filed a lawsuit against the North Dakota Legislative Assembly asking the court to block the resolution, which would amend term limits in the North Dakota Constitution. Former legislator Oley Larson and Grand Forks County Commissioner Terry Bjerke brought the lawsuit, claiming the measure is against state law.

“The people’s right to vote on such proposals was established at statehood and remains an integral part of the Constitution,” attorneys for the Legislature wrote in a brief to the court. “The Petitioners have not established any legal grounds to prevent the people from voting. This Court’s precedent requires the Petition be denied.”

No hearings have been set in the case.
