Bismarck, ND) -- A second lawsuit targeting House subdistricts that encompass tribal nations is alleging that they are unconstitutional.
Attorneys for North Dakota Republican Party District Four Chairman Charles Walen and District Nine GOP chairman candidate Paul Henderson say the formation of the subdistricts was based on racial gerrymandering. They argue the districts violate the Equal Protection Clause of the Fourteenth Amendment.
Top lawmakers say the subdistricts meet population criteria of the federal Voting Rights Act.
