(Bismarck, ND) -- North Dakota Representative Nico Rios has avoided jail time in a drunk driving case that led to a rant directed towards the officers at the scene.

Under a deal with prosecutors, Rios pleaded guilty to operating a vehicle when his blood alcohol content was above the legal limit. He'll have to serve a year of unsupervised probation and pay a $1,000 fine.

State GOP leaders have called for Rios to resign because of the "verbally abusive, homophobic, racially abusive, and discriminatory" comments he made towards officers during his arrest.
