BISMARCK, ND — State attorneys are asking a judge to dismiss a lawsuit centered around what was once North Dakota’s only abortion clinic.
The Red River Women’s Clinic is suing after state lawmakers passed a bill last year banning most abortions with a few exceptions. State attorneys say the lawsuit has no merit since lawmakers have included exceptions and allowed doctors to decide who qualifies for a legal abortion. The clinic’s attorneys say the law is vague and too confusing for doctors.
Because the clinic moved to Minnesota in 2022, state attorneys also say they don’t have the right to bring the case to North Dakota
