Attorney: Legal action brewing against Casselton soybean crushing plant

(Casselton, ND) -- An attorney representing a Casselton couple is talking about legal action against the city council, just 2 days after the council approved the conditional use permit for a soybean crushing plant in the city.

"What was particularly disappointing was the inability of the council to answer some very key and basic questions that community members had with respect to the plant," said Joshua Swanson.

Joshua Swanson represents Casselton residents Greg and Susan Kempel, who only oppose the plant's location. They're concerned about traffic issues, noise, and impacts on air quality in the city. Swanson says he anticipates bringing a class action lawsuit against the city if and when the plant is built at the location currently planned. Swanson says he sent a letter to the city council prior to their vote Monday night detailing his client's concerns, along with legal arguments supporting their position.
