(Beltrami County, MN) -- Prosecutors in Beltrami County have dropped a sexual assault charge against a Texas man due to a lack of evidence.
Twenty-two-year-old Oscar Luna was arrested in September after an 11-year-old girl from Bemidji said she was kidnapped and sexually assaulted. Prosecutors say DNA evidence gathered in the case does support a charge of criminal sexual conduct against Luna. The DNA gathered also does not match any other suspect connected to the case.
Luna is expected to plead guilty to charges of possessing a controlled substance.
