North Dakota joins lawsuit against U.S. Department of Transportation over CO2 regulations

(Bismarck, ND) -- North Dakota is joining several other states in court against the U.S. Department of Transportation and the Federal Highway Authority.

North Dakota Attorney General Drew Wrigley says the state is joining a coalition of 21 states to challenge a new ruling from the U.S. DOT that would require many states to reduce CO2 emissions. The lawsuit claims the DOT does not have authority to limit CO2 emissions, and that the ruling will disproportionally impact rural states.

“This rule is yet another effort by the Biden administration to unconstitutionally and unlawfully use federal administrative agencies to push a climate agenda where Congress has granted no authority to implement such actions,” said Attorney General Wrigley. “We will continue to push back against regulatory overreach by the Department of Transportation, and every other agency in the Federal government engaged in this sort of unlawful conduct.”
